Terms of Service

Welcome to Black Pines. These Terms of Service (“Terms”) are an agreement between you and Black Pines Life LLC (“Black Pines,” “we,” “us,” or “our”). They apply to your use of our website, the Black Pines app, and our text messaging program (together, the “Services”). Please read them carefully.
1. Accepting These Terms
By creating an account, using the Services, or opting in to our text messaging program, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
These Terms cover the Services only. They do not replace your Enrollment Agreement, house guidelines, or lease.
2. What Black Pines Is
Black Pines is a transitional living and mentorship program. We are not a treatment facility, and we are not a medical, mental health, legal, or financial provider. Nothing in the Services is medical, mental health, legal, or financial advice.
The Services are not for emergencies. In an emergency, call 911. If you or someone you know is in crisis, call or text 988.
3. Who Can Use the Services
You must be at least 18 years old to use the Services. Accounts are created for students, parents, emergency contacts, and others whom Black Pines has invited or approved.
4. Accounts and Security
Give us accurate and current information.
Keep your login details private. Do not share your account.
Tell us right away if you think someone else has used your account.
You are responsible for activity on your account.
We may suspend or close an account that breaks these Terms or puts others at risk.
5. Program Agreements and Housing
Your participation in the program is governed by your Enrollment Agreement and the house guidelines. Housing at Cottonwood House is governed by a separate lease. Program fees and rent are separate. If these Terms conflict with an Enrollment Agreement or lease, that document controls for the matters it covers.
6. Progress and Badge Records
The app helps track goals, coaching, phases, and badges. Progress in the program is milestone-based and confirmed by Black Pines staff. Records in the app are tools to support coaching. They do not guarantee any outcome.
7. Parent and Emergency Contact Access
Students are adults. A parent or emergency contact receives information about a student only as the student has authorized, in writing or in the app, or when it is needed in an emergency or safety situation. A student may change these choices by telling us. Parents and emergency contacts agree to keep any information they receive private and to use it only to support the student.
8. Acceptable Use
When you use the Services, you agree not to:
Break the law or violate anyone’s rights.
Harass, threaten, or abuse anyone.
Pretend to be someone else.
Share another person’s private information without permission.
Try to access accounts, data, or systems you are not authorized to use.
Interfere with or disrupt the Services, including by uploading harmful code or scraping data.
Use the Services to send spam or messages you are not permitted to send.
We may remove content or restrict access when needed to keep the Services and our community safe.
9. Text Messaging Program Terms
The Black Pines app works with a text messaging program (“Texting Program”). These terms apply to the Texting Program. By opting in, you agree to them.
A. Texting is optional. You choose whether to receive texts. Agreeing to receive texts is not a condition of enrolling in the program, using the app, or using any other part of the Services.
B. How you opt in. You opt in by checking an unchecked consent box in the app or on a Black Pines form, by texting a keyword to our program number, or by signing a written consent form. By opting in, you confirm that you are the account holder or regular user of the phone number you provide, and that you agree to receive recurring text messages from Black Pines at that number, including messages sent using an automated system.
C. What we send. Texts may include coaching and appointment reminders, schedule changes, house and program notices, progress notifications from the app, and replies to your messages. Parents and emergency contacts opt in separately and may receive program updates that the student has authorized. We try to send non-urgent texts between 8:00 a.m. and 9:00 p.m. Mountain Time.
D. Frequency and cost. Message frequency varies. Message and data rates may apply, depending on your mobile plan.
E. How to opt out. Reply STOP to any text at any time. You will get one confirmation message, and we will stop texting you. You can opt in again at any time. Reply HELP for help, or contact us using the details below.
F. What opting out does. Opting out stops texts only. You stay enrolled, and you keep your access to the app. We may still reach you by app notification, email, phone, or in person about important program matters.
G. Keep your number current. Tell us if your phone number changes or if you no longer use it, so that texts do not go to someone else.
H. Not for emergencies or sensitive details. Texts are not monitored around the clock. In an emergency, call 911. Do not send passwords, financial details, or sensitive personal information by text. Texts may be read by authorized Black Pines staff.
I. Carriers. Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device.
J. Privacy. How we use and protect information related to the Texting Program is described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
10. Ownership and Content
Black Pines owns the Services and everything in them, including the curriculum, badge system, branding, text, and design. We give you a limited, personal, non-transferable right to use the Services for their intended purpose. You may not copy, sell, or reuse our materials without our written permission.
You keep ownership of the content you submit. You give us a limited right to use, store, and display it as needed to operate the Services and support your participation in the program. If you send us feedback or ideas about the Services, we may use them without owing you anything.
11. Third-Party Services
The Services rely on third-party tools, such as online learning, email, and text delivery providers. Their own terms and policies may also apply. We are not responsible for services we do not control.
12. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent the law allows, we make no promises that the Services will be uninterrupted, error-free, or secure, and we do not guarantee any particular result from using the Services or taking part in the program.
13. Limits on Liability
To the fullest extent the law allows, Black Pines and its owners, staff, and service providers are not liable for indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim about the Services is limited to $100. Nothing in these Terms limits liability that cannot be limited by law, and these Terms do not change the rights and responsibilities in your Enrollment Agreement or lease.
14. Your Responsibility for Misuse
You are responsible for losses and claims that result from your misuse of the Services or your violation of these Terms, to the extent the law allows.
15. Suspension and Ending Access
You may stop using the Services at any time. We may suspend or end your access if you break these Terms, if your enrollment or role with Black Pines ends, or if needed for safety or legal reasons. Sections that by their nature should continue, such as ownership, disclaimers, and limits on liability, will continue after access ends.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the “Last Updated” date above. If a change is significant, we will give you additional notice, such as by email or in the app. Using the Services after a change means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict of law rules. If you have a concern, please contact us first and give us 30 days to work it out with you. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Salt Lake County, Utah, and you agree to their jurisdiction.
18. General
These Terms and our Privacy Policy are the entire agreement between you and Black Pines about the Services. If any part is found unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, that does not waive our right to do so later. You may not transfer your rights under these Terms without our written consent.
